Witam, mam przyjemności przedstawić Ci system edukacyjny prawa w Wielkiej Brytanii.
Na początku warto wspomnieć, że system ten został wprowadzony zgodnie z postanowieniami traktatu bolońskiego z 1999 roku. Skutkiem jego podpisania jest dwustopniowy podział studiów prawniczych w Anglii. Większość studentów kończy edukację na poziomie licencjackim, natomiast Ci, którzy są szczególnie zainteresowani jakąś dziedziną prawa lub chcą się dalej kształcić, kontynuują naukę na studiach magisterskich. Po trzech latach nauki (w Szkocji po czterech) otrzymuje się tytuł licencjata nauk prawnych (Bachelor of Laws) albo licencjata nauk humanistycznych (Bachelor of Arts). Żaden z tych tytułów nie daje kwalifikacji zawodowych, ale pozwala na ubieganie się o przyjęcie na aplikację.
Brytyjska aplikacja składa się z dwóch etapów: jednorocznego kursu zawodowego (Legal Practice Course lub Bar Vocational Course) oraz dwuletnich bądź jednorocznych praktyk (Training Contract lub Pupillage). Rodzaj kursu oraz praktyk uzależniony jest od wyboru ścieżki kariery – adwokata bądź radcy prawnego. Wykwalifikowanym prawnikiem można więc zostać w sześć lat od rozpoczęcia nauki w szkole wyższej.
Ale jak to wszystko wygląda od środka?
W Wielkiej Brytanii studenci uczą się przede wszystkim logicznego myślenia, argumentowania oraz wypowiadania własnych opinii. Już na poziomie studiów licencjackich są pod tym kątem przygotowywani. Równolegle ze zwykłymi wykładami odbywają się tzw. tutorials, czyli kameralne spotkania z profesorami, w których biorą udział studenci w grupach 6-8 osobowych (na bardziej prestiżowych uczelniach jest to maksymalnie trzech studentów). Niektóre przedmioty, zamiast egzaminów, kończą się praktycznym sprawdzianem np. przeprowadzenie symulacji rozprawy sądowej. Ciekawe jest to ,że zajęcia z logiki w brytyjskim systemie kształcenia prawników nie stanowią osobnego przedmiotu, są niejako wkomponowane w każde zajęcia. Już od pierwszego roku zaczynają się konkrety: prawo konstytucyjne, prawo administracyjne, prawo kontraktów.
Co dalej?
Po ukończonym szkoleniu kandydat zostaje przyjęty do Legal Society i staje się samodzielnym solicitorem. Oznacza to, że może udzielać porad prawnych klientom, reprezentować ich w arbitrażu lub negocjacjach, a także znaleźć zatrudnienie w instytucjach finansowych, lub administracji państwowej. Solicitor jest również niezbędnym ogniwem łączącym klienta z „adwokatem” (barrister) w sprawach karnych.

At the beginning it is worth mentioning that this system was introduced under the Treaty of Bologna in 1999. The result of his signing is a two-stage division of legal studies in Great Britain.
Majority of students end their education on degree of Bachelor, however they who want to continue their studies or are particularly interested in any kind of branch of law, they go on Master studies. After three years study (in Scotland after four years) we can get a title of Bachelor of Laws (LLB) or Bachelor of Arts (BA). Neither of these titles not give us of professional qualifications but it allows you to apply for admission to the applications.
British application consist of two steps: one-year vocational course (Legal Practice Course for solicitors or Bar Vocational Course for barristers) and two-year or one-year apprenticeships (Training Contract for solicitors or Pupillage for barristers). The kind of course and apprenticeship is dependant from choice of career path - barrister or solicitor. So, we can be qualified lawyer in the six years from begin studies in the university.
But, how it work from inside?
In Great Britain students learn first of all logical thinking, argumentation and expressing their views. Already on level Bachelor studies they are trained in this regard. In parallel with the usual lectures are held so-called "tutorials" that is a cameral meeting with professors. In ordinary college it is a group of six-eight students but on most prestige universities it's a group of maximally three students. Instead of normal exams, some of subjects end with practical test e.g. conduct simulation of lawsuit. It is interesting that in the British education system of lawyers lessons from logic aren't separate subject they are integrated into each other subject. Already from the first year they start concretes: constitutional law, administrative law, contracts.
And what's next?
After completing the training, the candidate for a solicitor is admitted to the Legal Society and becomes an independent solicitor. This means that it can provide legal advice to customers, to represent them in arbitration or negotiation, as well as to find employment in financial institutions, or government. Solicitor is also a necessary link between the client with a barrister in criminal matters.
